4.         SUMMARY OF EXCEEDANCES, COMPLAINTS, NOTIFICATION OF SUMMONS AND SUCCESSFUL PROSECUTION

 

4.1       Summary of Exceedance of the Environmental Quality Performance Limit

 

4.1.1    Summary of Action and Limit Level exceedance of 1-hr TSP level and 24-hr TSP level at AMS6 is reported in the monthly EM&A Reports (for September 2016, October 2016 and November 2016) prepared by Contract No. HY/2011/03.

 

4.1.2  There was no Action and Limit Level exceedance of 1-hr TSP level and 24-hr TSP level recorded at station AMS7 by the Environmental Team of Contract No. HY/2010/02 during the reporting period.

 

4.1.3    There was no Action and Limit Level exceedance for noise recorded at station NMS2 and station NMS3B by the Environmental Team of Contract No. HY/2010/02 during the reporting period.

 

4.1.4    There was no marine works conducted during the reporting period and therefore, no relevant monitoring result is reported.

 

4.1.5    There was no marine works conducted during the reporting period and therefore, no ecology monitoring result is reported.

 

4.2       Summary of Complaints, Notification of Summons and Successful Prosecution

 

4.2.1    There were two complaints received in relation to the environmental impact during the reporting period. The summary of environmental complaints is presented in Table 4.1. The details of cumulative statistics of Environmental Complaints are provided in Appendix I.

            (a) 22 September 2016 (Log No. 002)

 

The complaint was received by EPD from a member of the public on 22 September 2016 complained about two site flat top barges came from Tuen Mun everyday and observed that whitish effluent discharged into the sea from 1800 to 0400 near Cell No. 54 to 55 of HZMB construction site which creates pollution during the reporting period. After investigation, it was concluded that the complaint was not related to the construction site activities of Contract No. HY/2013/03. Nevertheless, the contractor had been reminded to comply with the requirements stipulated in the Environmental Mitigation Implementation Schedule (EMIS) of the EM&A Manual, in particular:

 

            Water Quality: W1 –

 

1.       barges and hopper dredgers shall have tight fitting seals to their bottom openings to prevent leakage of material;

2.       any pipe leakages shall be repaired quickly. Plant should not be operated with leaking pipes;

3.       loading of barges and hoppers shall be controlled to prevent splashing of dredged material to the surrounding water. Barges or hoppers shall not be filled to a level which will cause overflow of materials or pollution of water during loading or transportation;

4.       excess material shall be cleaned from the decks and exposed fittings of barges and hopper dredgers before the vessel is moved;

5.       adequate freeboard shall be maintained on barges to reduce the likelihood of decks being washed by wave action;

6.       all vessels shall be sized such that adequate clearance is maintained between vessels and the sea bed at all states of the tide to ensure that undue turbidity is not generated by turbulence from vessel movement or propeller wash; and

7.       the works shall not cause foam, oil, grease, litter or other objectionable matter to be present in the water within and adjacent to the works site.

 

            (b) 10 November 2016 (Log No. 003)

 

The complaint was received by EPD from a member of the public on 09 November 2016 complained about water quality pollution was observed behind a barge on 07 November 2016 at 09:26 am from the footbridge near Tung Chung Pier. A barge travelled from Hong Kong Zhuhai Macao Bridge near Scenic Hill site boundary to Tung Chung Pier’s front sea area, turbid water was observed behind a barge which creates water quality pollution during the reporting period. After investigation, it was concluded that the complaint was not related to the construction site activities of Contract No. HY/2013/03. Nevertheless, the contractor had been reminded to comply with the requirements stipulated in the Environmental Mitigation Implementation Schedule (EMIS) of the EM&A Manual, in particular:

 

            Water Quality: W1 –

4.2.2    No notification of summons or prosecutions was received during the reporting period.
